The Clearfield/CO-OP ATV Contest is conducted by Federated Co-operatives Limited, Dow Agro Sciences LLC, Brett Young, and BASF Corporation (hereinafter referred to as the “Sponsors”) and are governed by the rules and regulations hereinafter set out as well as the laws of Saskatchewan.
CONTEST PERIOD:
The Clearfield/CO-OP™ ATV Contest (the "Contest") begins on at January 1, 2012 12:00:01 a.m. Central Time ("CT") and ends on April 30, 2012 at 9:59:59 p.m. CT (the "Contest Period").
ELIGIBILITY: This Contest is only open to legal residents of Alberta, Saskatchewan and Manitoba who have reached the age of majority in their province of residence as of January 1, 2012.Employees (and those persons with whom they are domiciled) of the Contest Sponsors their affiliated companies or agents, their retail co-operative members, respective advertising or promotional agencies, the Independent Judging Organization or other representatives or members of the respective immediate families of such employees are not eligible to enter (collectively “Contest Sponsors”).
HOW TO ENTER:
No purchase necessary. To enter online, please go to www.cooppromotions.com or enter on your smart phone with your QR code reader and:
a) Click on the Clearfield/CO-OP™ ATV Contest link and complete the online registration form with the following information: full name, complete mailing address including postal code, daytime and evening telephone numbers (including area code), and valid email address.
b) To enter via your Smartphone (available on the following Smart Phone models: iPhone, Blackberry, Android Powered and Windows Phone 7), scan the ATV Contest QR Code found on in-store contest posters with your Smartphone QR code reader. Once scanned a mobile version of the Contest Website will be loaded and displayed on your phone. Follow the on-screen instructions to complete the entry form.
c) After having read and agreed to these Official Rules, click the submit button to submit your on-line registration and receive one (1) entry into the Contest. Any available opt-in opportunities are not required to enter this Contest, and checking any opt-in boxes will not improve your chances of winning.
Limit one (1) entry per person, household and/ or email address.
If it is discovered that you attempted to enter more than once during Contest Period, then all your entries in this Contest will be void. Multiple entries per Contest Period by the same person using any device or method to play multiple times or as multiple contestants will result in disqualification.
All entries are subject to verification. Contest Sponsors reserve the right, in their sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Contest Sponsors) to participate in the Contest. Failure to provide such proof in a timely manner may result in disqualification.
By entering this Contest, you agree to be bound by the decisions of the Contest Sponsors, which are final and binding without right of appeal with respect to all matters relating to the Contest.
PRIZE:
One (1) Grand Prize will be awarded consisting of: 2012 Arctic Cat 550i GT ATV. Winner must possess a valid driver’s license from their province of residence to be eligible to receive the prize. Approximate retail value $10,450 CDN.
The ATV will be delivered to the winner at the Co-op Agro Centre closest to the winner’s residence. The delivery date of the ATV is subject to product availability and may take up to 6 months after the official order date. The winner must take delivery of the Vehicle within 30 days of notification that the Co-op has received the Vehicle. The Sponsor reserves the right to make such changes. Optional equipment may vary by region.
The selected entrant must be a valid licensed driver in their province/territory of residence and will be required to provide proof of insurance at time of delivery. Failure to show same may result in prize forfeiture and the drawing of another selected entrant.
The Grand Prize must be accepted as awarded and is not transferable or convertible to cash. The Sponsor reserves the right, at its sole and absolute discretion, to substitute the Grand Prize with another ATV (including without limitation, but at Sponsor’s sole and absolute discretion, a cash award), of equivalent or greater value or of a different model year for any reason whatsoever including, but not limited to: production delays caused by labour disruptions, part shortages, adverse weather conditions or other unforeseen events, or any other reasons.
WINNER SELECTION:
A random draw for the Grand Prize will be conducted by the Independent Judging Organization May 4, 2012, at approximately 2:00 pm (ET), in Uxbridge, Ontario.
Odds of winning are dependent on the number of eligible entries received during the Contest Period.
NOTIFICATION AND QUALIFICATION OF SELECTED ENTRANT:
The selected entrant will be notified by mail, e-mail or telephone and in order to qualify as a prize winner, the selected entrant must first correctly answer a time-limited mathematical skill-testing question to be administered by mail, e-mail or telephone. If the question is answered incorrectly or not within the time allotted, the prize is forfeited and will be available to be won by another Contest entrant; and within 10 days of notification, sign and return a declaration of eligibility and a liability/publicity release (“Winner’s Declaration & Release”) containing provisions whereby the selected entrant confirms compliance with the Contest rules, accepts the prize as awarded, without substitution, and releases the Sponsor, its affiliated and related companies, advertising and promotional agencies, the Administrator, and each of their respective shareholders, directors, officers, employees, agents, representatives, successors and assigns from any liability in connection with a prize or the Contest. If the Winner’s Declaration and Release is not returned within the specified 10-day time period, the prize is forfeited and will be available to be won by another Contest entrant.
In addition, the selected entrant for the Grand Prize must hold a valid driver’s license and must have satisfactory proof of insurance.
By accepting their prize, winner consents to the use of his/her name, age, city and province/territory, photograph and likeness in any publicity related to the Contest carried out by the Sponsor, without compensation, worldwide and in perpetuity, in any and all forms of media now known or hereafter devised, including the Internet unless prohibited by law. Any costs or expenses incurred by the winner in claiming or using their prizes will be the responsibility of the winners.
Neither the Sponsors nor the Independent Judging Organization, are responsible for any lost, misdirected or late entries or any problems or technical malfunctions of any telephone network or lines, computer online systems or servers, computer software problems or traffic congestion on the internet or at any website and assume no liability for damage to entrant's or any person's computer resulting from participating in the Contest. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be deemed to have been made by the authorized account holder of the e-mail address or telephone number at the time of entry. “Authorized account holder” is the natural person who is assigned an e-mail address by an internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question or who is assigned a telephone number by the telephone service provider.
No correspondence regarding entries will be entered into with entrants, except as provided in these Official Rules. By entering the Contest, entrant agrees that the Sponsors and the Independent Judging Organization shall not be held responsible for, and the entrants have no right to bring (and covenant and agree not to bring), any claim, action, or proceeding of any kind or nature whatsoever against Sponsors and/or their parent companies, affiliated companies, subsidiaries, divisions, advertising and promotion agencies, participating retailers, and all of their respective agents, employees, directors, officers, shareholders, successors and assigns (collectively "Releases") in connection with this Contest.
By entering this Contest, entrant agrees that the Sponsors and the Independent Judging Organization shall not be liable for injury, loss or damage of any kind resulting from the acceptance, use or misuse of any Prize, including any travel related thereto or otherwise from participation in this Contest, and that the entrant has no right to bring (and covenants and agrees not to bring) any claim, action, or proceeding of any kind or nature whatsoever against the Sponsors and/or their parent companies, affiliated companies, subsidiaries, divisions, advertising and promotion agencies, the Independent Judging Organization, and all of their respective agents, employees, directors, officers, shareholders, successors and assigns (collectively "Releases") in connection with this Contest. By entering and/or accepting a Prize, the entrant agrees to be bound by these Official Rules and the Independent Judging Organization’s decisions and to release all Releases from any and all liability, loss or damage of any kind arising out of or in connection with entrant’s participation in this Contest or with respect to the awarding, receipt, possession, use and/or misuse of a Prize or participation in any Prize.
The Sponsors reserves the right, in its absolute discretion, to modify, cancel, terminate, or suspend all or any part of this Contest at any time for any reason without prior notice, subject to applicable laws. In such case, the Sponsor may, but shall not be required to, in its absolute discretion, determine the winner in accordance with these Official Rules from among all valid, non-suspect entries received prior to the event which warranted such action.
The Sponsors reserve the right at its sole discretion, to disqualify any individual who (i) tampers with, or attempts to tamper with, the entry process; or (ii) violates any of these Official Rules.
GENERAL: This Contest is subject to all applicable federal, provincial and municipal laws and regulations. By entering this Contest, participants agree to be bound by these Official Rules and by the decisions of the Independent Judging Organization, which shall be final with respect to all matters relating to the Contest. All entries become the property of the Sponsors and none will be returned. By completing an entry form, all entrants consent to the collection, use and distribution of their personal information by the Sponsors for the purposes of running the Contest (information is stored for approximately 1 year.) The Sponsors will not sell or transmit this information to third parties except for the purposes of administering the Contest. The Sponsors and/or its affiliates may use the personal information of those contest entrants who provide such consent by checking the opt-in permission box on the contest entry form for the future distribution of any contests, promotions and product news. Notwithstanding the above, as a condition of being awarded a Prize, Prize Winner of the Contest will be required to grant the Sponsors the right to use the Prize Winner’s entry, name, home address (city and province), image and likeness, voice and comments for advertising, publicity and promotion purposes without territorial, time or use limitations, including without limitation online announcements without additional compensation, unless prohibited by law. Prize Winner agree to cooperate in any investigation by or on behalf of the Sponsors to confirm their eligibility and to help ensure that the use of any such potential winner in advertising or publicity for the Contest will not bring the Sponsors into public disrepute, contempt, scandal or ridicule or reflect unfavorably on the Contest or the Sponsor as determined by the Sponsors in its sole discretion. Subject to applicable law, the Sponsor reserves the right to cancel, terminate, modify the rules or administration of or suspend the Contests in whole or in part without prior notice with no obligation or liability, including if for any reason either of the Contest is not capable of running as planned, whether due to technical failure, or computer virus, tampering, fraud, or corruption of security or proper administration of the Contest or other causes beyond the control of the Sponsors. In such event, a winner(s) may be selected by randomly drawing from among all valid entries received up to the time of cancellation, termination or suspension.
Privacy Clause: The Sponsors respect your right to privacy and will use your personal information only to conduct the Contest and for the purpose as described in these Rules. Information collected is used solely to administer the Contest and is not sold, transferred, rented or loaned to any third parties. No correspondence will be entered into except with selected entrants, unless entrants otherwise agree.
